 The Asbestos Hazard Emergency Response Act (AHERA) requires all public and non-profit private K-12 schools to implement comprehensive programs for managing asbestos-containing building materials (ACBM) in their buildings.

AHERA REQUIREMENTS

Initial Inspection & Re-inspections

  • Conduct an initial, thorough inspection of all school buildings to identify the presence, location, and condition of all asbestos-containing building material (ACBM).
  • Re-inspect all identified ACBM every three years by an accredited inspector to reassess its condition.

Asbestos Management Plan

  • Develop and maintain a detailed, site-specific Asbestos Management Plan for each school.
  • The plan must be kept on file at the school and the administrative office, and must be available for public review.
  • It must outline recommended response actions (including operations and maintenance procedures) for all ACBM.

  • Designate a staff member to oversee all asbestos management activities. This person must receive specific training. 
  • Ensure compliance responsibilities are properly implemented.

  • Provide annual written notification to parent, teacher, and employee organizations regarding the availability of the Asbestos Management Plan
  • Detail any asbestos-related activities (inspections, response actions) taken or planned for the year.

  • Provide two-hour asbestos awareness training for all custodial and maintenance staff who may work in areas containing ACBM. 
  • Provide an additional 14 hours of detailed training for all custodial and maintenance staff who conduct any activities that will result in the disturbance of ACBM.

  • Perform a visual, periodic surveillance of all known or suspected ACBM every six months.
  • Document any changes in its condition or potential for disturbance.

  • Implement appropriate response actions (such as repair, encapsulation, enclosure, or removal) to address damaged or significantly damaged ACBM, following protocols outlined in the management plan. 
  • Use appropriate warning labels on friable ACBM that remains in the building.

Ensure that all tasks related to asbestos—including inspections, management plan development, and abatement/response actions—are performed only by personnel who are trained and accredited by the state under the EPA’s Model Accreditation Plan (MAP).
